Terms & Conditions

These Terms & Conditions apply to the public website, software-platform (including all features) and all SMS messages sent or received in connection with the services provided by YourMediaMate. By accessing or using any part of those services, including responding to or initiating SMS, you agree to be bound by the Terms as they stand on the date of use. We may change the Terms at any time; changes will take effect when published on our website.

SMS Disclosure

You authorise YourMediaMate to send you text messages that may include account authentication codes, transactional alerts, promotional offers, reminders and other service-related updates. Message frequency varies with your activity and preferences. Standard message and data rates apply under your carrier plan.

- Opt-out: Reply **STOP** to any message to cancel further marketing texts. Transactional or security-critical texts may still be sent if legally permitted.

- Help: Reply **HELP** for assistance, or email [email protected].

- Delivery: Message delivery is not guaranteed and may be delayed or fail due to carrier congestion, device settings or other factors beyond our control.

Messaging Consent

We send SMS only where you have given express or inferred consent consistent with the Spam Act 2003 and Australian Communications and Media Authority (ACMA) industry rules. You may withdraw consent at any time by using the **STOP** command described above.

User Obligations

When using our website, SaaS platform or SMS channel you must not:

- engage in unlawful, fraudulent, defamatory, harassing or abusive conduct;

- transmit malware, viruses or code intended to disrupt or interfere with our systems or other users;

- harvest or scrape data without written permission;

- send unauthorised commercial messages or “spam” through any feature we provide;

- misuse any intellectual-property or content provided by YourMediaMate or others.

Rebilling Terms

Our one-time Trial Month is only available as your first month with us and cannot be accessed after another plan length has already been used. This trial is not part of an ongoing subscription and will not automatically rebill; your access will simply end at the conclusion of the month. However, if you select a 1, 3, or 12-month plan, your subscription will automatically renew for the same duration unless a cancellation request is received before the end of the current period. Re-billing will continue until cancellation is requested.

Cancellation Terms

By selecting a specific plan length (such as 3 months), you agree to commit to that full billing period. Each plan is billed monthly, and any early cancellation will not release you from the remaining payments due for the duration of the selected plan. This structure allows us to offer discounted rates for longer commitments. If you choose to cancel, rebilling will stop at the end of your current plan period, and you will not be charged beyond that point.

Switching Between Plans

If you wish to switch between plans, there are two options: upgrading or downgrading within the same package. When upgrading to a higher-tier plan, access to the new features will be granted within 48 hours of payment for the upgraded plan. Please note that payments already made on your current plan will not be partially refunded or credited. If you choose to downgrade, you will continue using your current higher-tier plan until the end of its billing period. Once that period ends, your subscription will move to the lower-tier plan and future billing will reflect the new, lower rate. This delayed switch is due to the fact that your current plan already includes all the features of the lower-tier option.

Trial Month Eligibility and Misuse

The Trial Month is a one-time offer designed to give new users a first look at what we offer. It is only available as your very first month with us, and cannot be used after selecting any other plan length within the same package. If you have already purchased a 1, 3, or 12-month plan, you are no longer eligible for the Trial Month, regardless of whether that plan has concluded.

Attempting to purchase the Trial Month multiple times, or after already using our services under another plan, is considered a breach of our terms. If such activity is detected, your account will be automatically deleted without warning or consideration.

Google My Business Access

By utilising the services, features and products with YourMediaMate, you agree to provide our team with administrative or managerial access to your Google My Business account (only if required for a product/service purchased by the consumer to be provided) for the purpose of optimisation, SEO integration, and enabling automation functionalities. YourMediaMate will manage your account professionally and ethically, without making significant changes outside the agreed scope of work. You retain ownership of your Google My Business account at all times and may revoke access upon written request. We are not liable for any changes or disruptions to your account that occur due to external factors beyond our control.

Intellectual Property

Nothing in these Terms grants you ownership or a licence beyond what is necessary for ordinary, personal use of our services and products. You must not copy, modify, publish, distribute, reverse-engineer or create derivative works without prior written consent.

Disclaimer

The services are offered “as-is” and “as-available”. To the maximum extent allowed under the Australian Consumer Law we make no warranties, express or implied, about accuracy, reliability, uninterrupted availability, error-free operation or fitness for a particular purpose; however we try our best to satisfy the needs of our customers, and achieve their desired and expected standards.

Limitation of Liability

Where liability cannot be excluded by law, our total aggregate liability arising out of or in connection with the services (whether in contract, tort or statute) is limited to total subscription fees you paid to us in the month before the event giving rise to the claim.

Indemnity

You agree to indemnify and hold harmless YourMediaMate and its employees against any loss, damage, claim or expense (including reasonable legal costs) arising from your breach of these Terms or your misuse of the services.
